Terms and Conditions with the Purchaser 1.1 The Buyer acknowledges and agrees that the sale of the Lot will be subject to the terms and conditions set out in Schedule 1 of the AuctionsPlus User Agreement (Standard Terms of Sale), and the terms and conditions set out in clauses 1.2 to 1.6 below. 1.2 The Buyer must, or must arrange for its nominated service provider to: 1.2.1 collect and transport the Lot from the Vendor’s nominated pick-up address at the date and time specified by the Vendor; 1.2.2 provide a vehicle to transport the Lot that is fit for purpose and complies with all applicable laws that apply to the transportation of the Lot; 1.2.3 secure the Lot safely to the vehicle; and 1.2.4 wear, or ensure its personnel or nominated service provider’s personnel wear, safety equipment that is fit for purpose and complies with all applicable laws (including work health and safety laws. 1.3 The Buyer must pay for all transportation costs associated with the collection or delivery of the Lot. 1.4 Subject to the Buyer’s compliance with clause 1.2, the Vendor will use its best efforts to assist with the loading of the Lot into the Buyer’s vehicle, however if the Vendor considers (in its absolute discretion) that the Buyer’s vehicle is not fit for purpose to transport the Lot, then the Buyer acknowledges and agrees that: 1.4.1 the Vendor may elect not to assist with the loading of the Lot into the Buyer’s vehicle; and 1.4.2 the Buyer must either provide an alternative vehicle that meets the Vendor’s requirements, or procure its own personnel to load the Lot onto the Buyer’s vehicle. 1.5 The Buyer acknowledges and agrees that: 1.5.1 for the purposes of clause 4 (Title and Risk) of the Standard Terms of Sale, possession and control of the Lot occurs upon the Buyer collecting and loading the Lot from the Vendor’s nominated pick-up address; 1.5.2 the Vendor will not be liable for any Claim that arises from or occurs during the delivery, loading, transportation or collection of the Lot; 1.5.3 the Vendor does not make any representation in relation to, nor guarantee nor accept any liability for the existence, quality, condition, safety or legality of any Lot advertised; and 1.5.4 the Vendor’s total maximum liability to the Buyer for all Claims sustained, incurred or suffered by Buyer arising under or in connection with all Sales, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited in the aggregate to an amount equal to the Fees paid by the Buyer to the Vendor or the Vendor’s agent for the Lot giving rise to the Claim. 1.6 Capitalised terms used in the above clauses have the meaning given in clause 18 of the AuctionsPlus User Agreement.
